No, California has no marriage requirements for adoption. However, as a national adoption agency, American Adoptions has requirements of its own that satisfy all state laws rather than just those of California. Currently, American Adoptions is only accepting couples who have been married for at least two years. Can You Finalize An International Adoption In California

California residents may finalize an intercountry adoption or a readoption through court action the process requires the involvement of a licensed adoption agency.

In California, adopting a child internationally is permitted as long as the child is from a Hague Convention country. The Hague Convention is an international agreement put in place to safeguard intercountry adoptions.

Rights to enter the U.S. are not granted automatically with foreign adoption, so Adoptive Parents in California may have to go through a readoption process required by the Department of Homeland Security. Readoption is when the foreign adoption is reviewed and legitimized in a state court and the process usually includes:

  • At least one postplacement home visit
  • An adoption petition
  • A home study
  • The final adoption order

After finalizing the readoption, the child will be issued a Court Order Delayed Registration of Birth. This document has the same status as a Certificate of Live Birth, will bear the childs new legal name, and the adoptive parents are listed as the childs parents.

  • Fost-adopt is the process of adopting a child, siblings, or teen from foster care.

Most birth parents in B.C. planning to place their baby up for adoption work with licensed agencies.

In the case of infants, there are two options for placement in B.C.:

  • Agency placement: Birth parents place the child with an adoption agency until they find an appropriate adoptive family.
  • Direct placement: Birth parents work with an agency to place the child with someone they know . The prospective adoptive parents will have a pre-placement assessment completed by the adoption agency. Both the birth parents and the adoptive parents have joint guardianship until the adoption order is granted

In either case, infants are placed with licensed adoption agencies and not generally with the Province of British Columbia.

Although children may come into government care at birth, birth parents have a right to work with the B.C. Government in terms of the return of their children.

The Adoption Act, 2013 provides for openness in the release of adoption information. Persons adopted under this Act or a former Act may, at age 19 years old, apply to Vital Statistics for copies of their original birth registration and adoption order.

When an adopted person has reached their 19th birthday, birth parents may apply to Vital Statistics for copies of:

  • the adopted persons original birth registration
  • the amended birth registration with the name following adoption and,
  • the adoption order with the adoptive parent information removed to respect their right to privacy.

Adopted persons, at age 18 years, and birth parents who wish to maintain their confidentiality are provided with the opportunity to file a disclosure veto or no-contact declaration for adoptions finalized prior to April 30, 2003. The disclosure veto or no-contact declaration remains in effect until cancelled in writing or until one year after the death of the person who filed it.

An adopted person and adult relative may register with the Provincial Director to exchange identifying or non-identifying information providing no disclosure veto or no-contact declaration has been filed.

Differences Between Independent And Agency Adoption

In an agency adoption, the agency must be licensed by the State of California. The California State Department of Social Services offers a website with a listing of licensed agencies. Caution must be exercised that the entity is indeed a licensed agency and not a business using a name which implies it is an agency. California permits “facilitators” to assist in adoptions . Agency adoption first requires that the adoptive parent have a home study completed prior to the placement of a child. The agency then takes the relinquishment of the birth mother . For six months following the adoptive placement, the agency supervises the placement, and then can write to the court to approve the adoption. In a typical home study, the adoptive parents are fingerprinted , provide letters of reference, provide proof of marriage if married , complete a health and social history, and demonstrate a preparedness to provide a loving home. A court can then grant the adoption in a simple court hearing in which both adoptive parents and the child appear.

Since the late 1990s, private agency adoptions involving newborns are mainly open and involve direct contact between birth parents and the adoptive family, as in independent adoption. Public agency adoptions, however, are often closed, with little or no contact between the birth family and the adoptive family. This is usually because the child was already relinquished by the birth parents, or the court terminated their rights.
